Zakladate\u013e by bol povinn\u00fd vlo\u017ei\u0165 do nad\u00e1cie pr\u00edspevok aspo\u0148 vo v\u00fd\u0161ke 1 EUR a majetok by tvoril nada\u010dn\u00fd fond a ostatn\u00fd majetok nad\u00e1cie. S\u00fakromn\u00fa nad\u00e1ciu by mohli zalo\u017ei\u0165 iba fyzick\u00e9 osoby pomocou nada\u010dnej listiny, ktor\u00e1 by musela ma\u0165 formu not\u00e1rskej z\u00e1pisnice. Pr\u00e1va zakladate\u013ea s\u00fakromnej nad\u00e1cie by sa nedali previes\u0165 na in\u00fa osobu a neprech\u00e1dzaj\u00fa na pr\u00e1vneho n\u00e1stupcu.<\/p>\n<p>Po vzniku s\u00fakromnej nad\u00e1cie by zakladate\u013e a tretie osoby boli opr\u00e1vnen\u00e9 vklada\u0165 do s\u00fakromnej nad\u00e1cie majetok.
